Terms of Service

These Terms of Service ("Terms") govern your use of the KlyoChat platform operated by Pointerflow LLC. By creating an account or using KlyoChat, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use KlyoChat. By using the service, you represent that you have the legal capacity to enter into these Terms. If you are using KlyoChat on behalf of a company, you represent that you have authority to bind that company.

2. Account terms

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate and complete information when creating your account
  • One person or legal entity may not maintain more than one free account
  • You may not use KlyoChat for illegal purposes or in violation of these Terms

3. Acceptable use

You agree not to use KlyoChat to:

  • Send spam, unsolicited messages, or violate anti-spam laws (CAN-SPAM, GDPR, etc.)
  • Harass, threaten, or harm any person
  • Distribute malware, phishing links, or malicious content
  • Impersonate any person or organization
  • Violate any applicable laws or regulations
  • Violate the terms of service of connected platforms (Meta, Instagram, WhatsApp, etc.)

4. Subscription and billing

Paid plans are billed monthly or annually in advance. We use Stripe to process payments. Subscriptions automatically renew unless canceled before the renewal date. Refunds are handled on a case-by-case basis; contact support.

We may change pricing with 30 days notice. If you disagree with a price change, you may cancel before the change takes effect.

5. Your content

You retain ownership of content you create in KlyoChat (flows, messages, templates). By using KlyoChat, you grant Pointerflow LLC a limited license to process, store, and transmit your content solely to provide the service. You are responsible for ensuring you have the rights to any content you upload or send.

6. Intellectual property

KlyoChat and its original content, features, and functionality are owned by Pointerflow LLC and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.

7. Third-party integrations

KlyoChat integrates with third-party platforms (Meta, Instagram, WhatsApp, Stripe, Calendly, etc.). We are not responsible for changes, outages, or policy updates from these platforms. Your use of integrated platforms is subject to their respective terms.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINTERFLOW LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Warranty disclaimer

KLYOCHAT IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Termination

You may cancel your account at any time from account settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use KlyoChat immediately ceases. We will provide a data export for 30 days after termination.

11. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware.

12. Changes to Terms

We may update these Terms with 30 days notice for material changes. Continued use after notice constitutes acceptance.
